Full UK Ownership and Registered Title

At Birchmore Ltd, all properties we introduce are structured as full UK property ownership interests and are registered with HM Land Registry.

This means that legal ownership of the property is formally recorded within the official government land registration system for England and Wales.  We do not introduce unregistered land, informal arrangements, licence agreements or overseas title structures. All transactions are conducted within the UK legal framework.

What Is HM Land Registry?

HM Land Registry is the government body responsible for:

  • Recording ownership of land and property in England and Wales
  • Registering leases (where registrable)
  • Recording charges and mortgages
  • Maintaining the official title register
  • Providing publicly searchable ownership records

When a property is registered, the buyer’s legal ownership is formally recorded and protected within the UK legal system.

What Buyers Receive

Following completion and registration, the purchaser’s solicitor will obtain:

  • An Official Copy of the Title Register
  • The Title Plan
  • Confirmation of any registered restrictions or charges

For leasehold properties (as is typical with PBSA), the leasehold interest will be registered in the buyer’s name for the term specified within the lease.  This provides legal certainty and documentary evidence of ownership.

The Role of the Buyer’s Solicitor

Every purchaser is required to instruct an independent solicitor regulated by the Solicitors Regulation Authority (SRA).

The acting solicitor will:

  • Review the contract documentation
  • Investigate title
  • Confirm lease terms
  • Conduct pre-completion searches
  • Exchange contracts
  • Complete the purchase
  • Submit the Stamp Duty Land Tax return (where required)
  • Register the buyer’s ownership with HM Land Registry

The Land Registry application is submitted after completion and, once processed, the updated title confirms the buyer as the registered proprietor.

Leasehold Structure in PBSA

Most Purpose-Built Student Accommodation units are sold on a long leasehold basis.

This means:

  • The buyer owns a long lease interest (often 125 years or more, depending on scheme)
  • The freehold may be retained by the developer or management structure
  • The lease is fully registrable at HM Land Registry

Your solicitor will explain the rights, obligations and covenants contained within the lease before exchange of contracts.

Transparency and Legal Process

Birchmore Ltd does not hold client funds and does not act as a conveyancer.  All transactions are handled through regulated UK solicitors, and all property ownership is formally registered through HM Land Registry following completion.

This ensures that every purchase proceeds within the established UK legal system, with appropriate professional oversight.
